Online Ordering

We reserve the right to refuse your offer should it be necessary Payment

For Online Ordering, you are obliged to pay:

the restaurant the fee which it charges for the food (and any other products and/or services) you order, together with the restaurant’s delivery charges; and

food-ee.co.uk may charge the consumer a fee of £0.50 per order when it processes online orders and the Restaurant will pay the VAT element of this fee.

Food-ee.co.uk accepts the following forms of payment for online ordering:

Credit / Charge cards: Visa, Mastercard, American Express are accepted.

Debit Cards, such as Visa, Delta, Maestro or Switch are accepted.

In the event of food-ee.co.uk needing to issue a refund we will endeavour to credit your account within 21 working days.

The owner of the card used to make payment must present this card on receiving the order.

We act as commercial agents for the restaurants that appear on food-ee.co.uk. Accordingly, if you pay food-ee.co.uk the relevant amount using any payment method set out above, you will be deemed to have paid for your Order and you need not be concerned with whether the money paid via food-ee.co.uk is passed onto the restaurant you have ordered from.

Card payments are secure.

Food-ee.co.uk do not accept cheques, Diners Club or other means of payment other than those detailed above.

Product

Although every care is taken, some products may contain nuts.

Our sites will try to accurately copy the product names, descriptions, and allergenic warnings and other information from the data provided to us by third-party providers. However, it is the duty and obligation of the third-party provider to ensure that you are been made aware of any allergens within prepared food or beverages. We do not undertake any responsibility for bringing to your attention any dietary information, allergy warnings or other contents of the products on our sites.

Should you have any doubt regarding the allergen content, ingredients or origins of any of the products displayed on the sites, you must confirm the position with the third party provider directly before placing an order.

Promotions and Discounts

When submitting your order details, you may wish to offer to purchase the items specified in conjunction with a particular offer or promotion. To take advantage of this facility you will need to enter the appropriate promo code with your order details. These codes are presented on our menu and other items of promotional literature from time to time. Any such order will be subject to the specific terms and conditions of the promotion in question and will be subject to availability. We reserve the right to refuse or withdraw any food-ee.co.uk promotion or discount at any time Delivery Times.

Our aim is to meet a delivery window for our customers, agreed at the time of placing the order. Whilst we will do our utmost to meet this delivery time unfortunately there may be factors beyond our control that prevent us from meeting the time slot.

We shall have no liability whatsoever for any delay or failure to deliver to you where such delay or failure is caused by a circumstance beyond our reasonable control. Such circumstances include, but are not limited to; • Unforeseen Traffic Delays • Accidents Causing Delays on the Service Route • Severe Weather Conditions.

Placing an Order

Once you have selected your orders, you will be asked to confirm that your selection is correct and to confirm how you wish to make payment for that order or booking. You have the option to select an online electronic payment (PayPal or card payment via Stripe), payment upon delivery or payment upon collection.

It is your responsibility to ensure that your order or booking is accurate and you should thoroughly check the items or services which you have selected before confirming your selection.

If you have any questions or concerns regarding your order, including ingredients used cookery methods, price or availability or if you suspect that your order has been incorrectly calculated, you must contact the business directly. Once your order/booking is processed, you will receive an email, to the email address specified during your registration, confirming that your order has been received by us ("Confirmation Email"). Receipt of this email does not mean that your order has been accepted by the merchant. We ask that each of our merchant partners acts promptly to notify you in the event that they cannot meet your order or where your order requires modification to proceed. The merchant will contact you directly in such instances.

In the event that any payment made via our sites is declined, you will be advised of the position and your order will not be processed.

If the merchant rejects your order, you will be notified by email or a telephone call. There are circumstances where a merchant may not be able to process and deliver your order in a timely manner and may be required to reject it. You will be provided with an estimated delivery time for your order. This is generally estimated based on how busy the restaurant is, the geographical location of the restaurant to the place of delivery and any special event or incident which may otherwise affect the processing times. Neither we nor the restaurant can be held liable for any unforeseen delay in delivery to you.

Changing or cancelling an order

After the procession of your payment, you may not be able to amend or cancel your orders, save at the absolute discretion of the restaurant.

If you wish to attempt to amend or cancel your order after payment, you should contact the restaurant directly to discuss this. The restaurant, however, will not be under any obligation to cancel your order after you have made a payment.

Restaurant Rejection

Restaurants hold a complete right to reject your order request at any time after receiving your order because of many reasons like if they are too busy, food unavailability, weather conditions or any internal issues etc. In such a case, if your payment is already processed, your amount will be refunded back in accordance with our refund policy.

Refund Of Rejected or Cancelled Order

According to the standard banking procedure, once you submit your order that you are paying by credit or debit card & if your order has been authorised, your bank or card issuer will “ring-fence” the full amount of your order. Once a refund is authorised by the restaurant the money will reverse back into your debit or credit card but the funds will take between 3 to 10 working days or sometimes longer to show up in your bank account. Neither we nor the restaurant will be responsible or liable to you for the delay in your getting the refund back to your account.

Food Order Incomplete

On the rare occasion, if your product is taking too long to be delivered or items missing or you receive food that is not on your receipt, we will make it up to you. Please immediately contact the restaurant as soon as you notice that any food items were not received in your order. The product that has been used or altered in any manner will not be refunded under any circumstances. The restaurant reserve the right to refuse a refund of any product that does not meet the refund conditions at their sole discretion. The restaurant will usually offer you a refund or send a replacement as soon as the problem is confirmed.

Compensation:

If you are not satisfied with the quality of any Products or the service provided by a Restaurant and wish to seek a refund, a proportionate price reduction or any other compensation, you should contact the Restaurant directly to lodge your complaint and, where appropriate, follow the Restaurant's own complaint procedures. If you are unable to contact the Restaurant, or the Restaurant refuses to deal with your complaint, you can contact our Support Team on 03333 448 393 within 72 hours of placing your order and one of our Customer Care Advisers will attempt to contact the Restaurant in order to request compensation on your behalf. Please note, however, that the legal contract for the supply and purchase of Products is between you and the Restaurant that you place your order with. We have no control over Restaurants and the quality of the Products or services that they provide, and we are not able to provide, and have no responsibility or liability for providing, any compensation to you on behalf of any Restaurant.

Customer Satisfaction

Customer satisfaction is of highest priority & vital importance to us. Whilst we are not a party to any purchase made via these sites, we will try to assist you where possible in relation to any complaint or dispute relating to an order. We advise you to raise any issues with the third party provider directly prior to contacting us. In the event, you raise a complaint with us regarding your order if it’s taking longer than expected or any query about your order, we shall investigate the complaint at our earliest opportunity.

In case you wish to cancel your order after payment authorisation, you may contact our executives who will contact the restaurant to communicate your requests; however, that does not guarantee that the restaurant will agree to your request. The maximum compensation will not exceed the value of the order. We request you to share your feedback, reviews, and ratings on the websites to share your experience as your feedback helps us to improve our services.

Prices and Payment

All prices displayed include VAT but not delivery costs (which will be displayed separately where applicable) or any additional ordering fee as the individual restaurant may specify from time to time.

Any such additional charges will be clearly displayed on the total amount shown prior to your order confirmation. We shall use our best endeavours to check all displayed prices however, given the number of items displayed upon the websites from time to time, there is the possibility of an error or a scenario where prices have been altered but not updated. Where it becomes apparent that any item for which you have placed an order is incorrectly priced, we will advise you of this. To avoid doubt, however, the restaurant is under no obligation to complete an order for an incorrect price. In such circumstances, you will not be able to claim any compensation from the restaurant or us for the difference in the displayed price and the actual price of any item.

In the event that you make a payment online using a credit or debit card and intend to collect your order in person, you must ensure that you take the same payment card in which the payment was made to the restaurant as proof of identity. If the restaurant has a concern about your identity, it may not able to serve you.

Even where your payment has been authorized by your card provider, there may still be a delay in the money being removed from your account. You should not assume that because your account appears to still show your in balance prior to the transaction that payment will not be taken at a later date. Payment may take up to 60 days to be processed.

It is general banking practice that upon you authorizing your card provider to make a payment to the relevant restaurant, that they will "reserve" part of your available balance upon that card to the value of your order whilst they process the order. Even in the event that this order is not completed for whatever reason (including cancellation or rejection by the restaurant), there may be a delay of up to 5 to 10 working days before your card shows the return of the "reserved" balance to you. Neither the restaurant nor we have control over this and you should contact your card provider directly in event that you have any queries regarding this process.

When payment is made electronically for any order, we may provide the payment gateway to facilitate such an order. In such an instance, payments will be shown on your account as "food-ee.co.uk". In the event that we do process money on behalf of our partner restaurants, we hold such money in escrow for that partner and the act of payment via us does not form any form of contract between you and us regarding the services.

In the event of any dispute over payment, howsoever arising, you should raise this with the restaurant and/or your card provider or, in the case of any payment made via PayPal, with PayPal directly using the relevant "dispute" protocol. You will have no right to recourse against us directly for any failure in the service.

Age Restricted Items

Under the laws of England and Wales, certain items are restricted from use. When you place an order through the sites, you are confirming that you are at least 18 years of age or older and are capable of entering into a binding contract. If your purchase contains age-restricted items (such as alcohol or cigarettes) then you may be asked to show valid photographic identification either at the collection of your order or upon delivery. Failure to show satisfactory age proof will result in the age-restricted item not being provided to you.

Under the Licensing Act 1964, it is an offence for any person under the age of 18 to buy or attempt to buy alcohol. It is also an offence for a person over the age of 18 to buy or attempt to buy alcohol for the purposes of supplying it to someone under the age of 18 years of age.

Your Personal Data

You agree that personal data may be retained, used and disclosed by us and our agents for the purpose of complying with our obligations under these Terms and Conditions for delivery including, but not limited to, administering your order and complying with any legal obligations.

Trade marks and Copyright

All contents included on this site are the property of Foody-ee Limited trading as food-ee.co.uk and protected by UK copyright laws.

The content and software on this site may be used as either or both an information and shopping resource. Any other use including reproduction, modification, distribution, transmission, or republication of the content of this service is strictly prohibited. Amendments and Waivers to these terms and conditions.

None of our employees, agents, or representatives, has authority to alter, modify or waive any provision of these Conditions of order.

14. Food-ee may reject or cancel a voucher if, in its absolute opinion, it believes that the voucher is being used in breach of these Voucher Terms and/or the Specific Voucher Terms.

Offer Terms & Conditions

1. The following terms and conditions (Terms) will apply to all offers run by Foody-ee Limited of 71-75 Shelton Street, Covent Garden, London WC2H 9JQ

2. Offers are also subject to the Specific Terms and Conditions of each offer, which can be found on the specific offer page.

3. Customers will have agreed to these Terms and Specific Terms upon use. Food-ee reserves the right to refuse the use of the specific Offer or future Offers.

4. Offers are open to all UK residents over the age of 18, except employees of Food-ee, it's associated, holding or subsidiary companies, and their families, agents, or any third party which is/are directly connected with the Offer.

5. The benefit/benefits associated with Offers may not be awarded if the Offer is not claimed within the time period stated in the Specific Terms.

6. The benefit/benefits associated with Offers is/are non-exchangeable, non-transferable and no cash alternative is offered.

7. Food-ee reserves the right to replace, hold void, cancel, suspend, amend, or withdraw Offers at any time without prior notice if necessary.

8. Decisions made by Food-ee regarding any aspect of the Offer is final and binding.

9. Food-ee reserves the right to change, add to, alter, remove or modify any of these Terms and any of the Specific Terms at any time without prior written notice.

10. Personal information provided by the customer/customers to Food-ee are to be processed according to Food-ee’s privacy policy.
